Section 14
Functions, Duties and Jurisdictions

(1) After the establishment of the tribunal in accordance with this Act, the tribunal shall have the authority to initiate proceedings and dispose of cases related to debt recovery of banks and financial institutions within its jurisdiction. (2) The jurisdiction of the tribunal shall be exercised by all three members collectively. The opinion of the majority shall be considered as the decision of the tribunal. (3) Regardless of what is written in sub-section (2), if two members including the law member are present, the case can be processed and settled. Apart from the law member, in the presence of two members other than the decision of the case or the final order can be taken. (5) If the majority cannot be maintained even after submission according to sub-section (4), in the case of such a case, it shall be sent in writing to the Appellate Tribunal for disposal. (6) After the establishment of the Appellate Tribunal, the Appellate Tribunal shall have the final authority to hear the appeal on the order given by the Tribunal within its jurisdiction. (7) ) Regardless of what is written elsewhere in this Act, banks and financial institutions can only apply for debt recovery if the following conditions are fulfilled: (a) There should be sufficient discussions and activities with the debtor to cancel the debt, (b) There should be sufficient action taken by banks and financial institutions related to debt recovery and the debt has not been recovered.
